LIFEGUARD ON DUTY AT ALL TIMES

SWIMMING POOL RULES

LIFEGUARD ON DUTY HAS THE FULL AUTHORITY TO ENFORCE POOL RULES AND EXPEL ANY INDIVIDUAL FROM THE SWIMMING POOL COMPLEX FOR VIOLATION OF THE RULES.

  • CHILDREN MUST BE ACCOMPANIED BY AN ADULT (ADULT MUST BE 16 YEARS OLD)
  • SUITABLE ATTIRE (NO CUTTOFFS OR FRAYED CLOTHING)
  • NO PETS ARE ALLOWED IN THE SWIMMING POOL COMPLEX
  • NO DIVING (see General Conduct Guidelines 7.1)
  • NO HORSEPLAY, DUNKING OR WRESTLING
  • NO FOOD OR DRINK IN THE SWIMMING POOL
  • NO ALCOHOLIC BEVERAGES IN THE POOL COMPLEX
  • NO PROFANITY, RUNNING, SCREAMING OR SPITTING
  • NO BICYCLES, SKATEBOARDS, ROLLER BLADES/SKATES OR SCOOTERS ALLOWED

THE FOLLOWING SHALL BE PERMITTED:

  • WATER TOYS SHALL BE PERMITTED AT THE DISCRETION OF THE LIFEGUARD.  ONLY BALLS, FLOTATION TOYS, SNORKELS, FINS AND VOLLEYBALL NETS (see General Conduct Guidelines 7.15)
  • APPROPRIATE POOL FURNITURE MAY BE USED IN SWIMMING POOL COMPLEX
  • FOOD AND DRINKS ARE ALLOWED IN THE POOL COMPLEX, NO GLASS CONTAINERS
  • WALKMAN, CD PLAYERS WITH HEADPHONES (NO RADIOS)
  • POOL ADMISSION HOMESTEAD MEMBERS AND GUESTS MUST SIGN-IN THE REGISTRATION LOG.

GUEST POLICY

  • ALL GUESTS MUST BE ACCOMPANIED BY A HOMESTEAD MEMBER
  • A DAILY FEE OF ONE DOLLAR ($1.00) PER GUEST MUST BE PAID TO THE LIFEGUARD UPON ENTRY TO THE SWIMMING POOL COMPLEX.

POOL FACILITY RENTAL

Homestead Members may rent the Swimming Pool Complex to host a private party. Homeowner must be present. Parties may only be held before or after regular hours. Pool rental fees are $30/per hour with a two (2) hour minimum and a $60 Refundable Deposit will be returned providing the pool area and pool are clean. Checks should be made payable to Homestead POA. Lifeguard $15 per hr. with 10 people maximum per Lifeguard. Please refer to “Private Parties” Guidelines (12.0) for more pool facility rental policies.

HOMESTEAD POOL COMMITTEE MEMBERS

1. Definitions

1.1 Adult
The term Adult shall mean a person who has reached his or her sixteenth birthday.
1.2 Adolescent
The term Adolescent shall mean a person who has reached his or her twelfth birthday by the first day of September of the year in question, but who has yet reached his or her sixteenth birthday.
1.3 Association
The term Association shall mean Homestead Homeowners.
1.4 By-laws
The term By-laws shall mean the By-laws of the Association and all amendments and additions thereto.
1.5 Child
The term Child shall mean a person who has not reached his or her twelfth birthday by the first day of September of the year in question.
1.6 Individual
The term Individual shall mean any Adult, Adolescent, Child, or guest of a Member.
1.7 Member
The term Member shall mean the single, joint or common owner and family of any Homestead lot in accordance with the By-laws.  No Member may use pool unless that Member has paid the annual assessment mandated by the By-laws.
1.8 Pool Manager
The term Pool Manager shall refer to that person or entity with whom the Association contracts to operate and manage the Swimming Pool Complex, and those persons or entity’s agents and employees, including lifeguards.
1.9 Regular Hours
The term Regular Hours shall mean that daily period of time determined by the Associations Board of Directors during which the Swimming Pool Complex will remain open for operation, other than for parties, swimming lessons and swim team.
1.10 Swimming Pool Complex
The term Swimming Pool Complex shall mean that area within the fence and wall surrounding the Associations swimming pool.
1.11 Season
The term Season shall mean that period of time described in 10.1 of these Rules.

2. Adult Swim Periods

2.1 An Adult Swim Period shall be had during every hour of operation of the Swimming Pool Complex.  The Adult Swim Period will be held at ten minutes until the hour including the first hour.  During this hourly ten-minute period, only Adults may use the swimming pool and all Children and Adolescents must leave the swimming pool immediately upon the lifeguards’ instructions.

3. Alcohol Policy

3.1 The consumption of any alcoholic beverage in the Swimming Pool Complex during Regular Hours, swim lessons, swim practice, swim meets of the swim team and parties is prohibited.

4. Unattended Swimming

4.1 Unattended swimming by Children prohibited
No Child may enter the Swimming Pool Complex unless accompanied by an Adult who shall be actually responsible for the conduct and well-being of said Child or Children.  Adolescents may swim without an Adult presence.
4.2 Continuous presence of Adult required
No Child shall remain in the Swimming Pool Complex if the Adult responsible for that Child leaves the Swimming Pool Complex, unless another Adult expressly informs the lifeguard that he or she will assume responsibility for the Child whose responsible Adult is leaving the Swimming Pool Complex.
4.3 Supervision of Children
If a Child cannot swim, the Adult responsible for that Child shall be in the swimming pool while the Child is in the swimming pool.

5. Attire

5.1 Suitable attire required
No individual wearing cutoffs or frayed clothing may enter the swimming pool.

6. Discipline

6.1 Authority of Lifeguard
The Pool Manager shall have full power to enforce these rules and has the power to expel any Individual from the Swimming Pool Complex for the remainder of the day for violating these rules.
6.2 Termination of privileges
Refusal by an Individual to leave the Swimming Pool Complex when directed by the Pool Manager shall result in the revocation of that Individuals swimming pool privileges for the remainder of the Season.  Nothing in this Paragraph 6.1 shall be deemed to serve as limitation upon the Associations Board of Directors power to affect other or alternate discipline, all as more further provided by the By-laws.
6.3 Cumulative Expulsions
An Individual who is expelled from the Swimming Pool Complex three times pursuant to Paragraph 6.1 of these Rules shall lose his or her rights to enter the Swimming Pool Complex for the remainder of the Season.  Nothing in this Paragraph 6.3 shall be deemed to serve as a limitation upon the Associations Board of Directors power to affect other or alternate discipline, all as more further provided by the By-laws.

7. General Conduct Guidelines

7.1 Diving
Diving head-first into the swimming pool is prohibited except along the 9 foot wall behind the red line.
7.2 Furniture
Lawn furniture may be brought by individuals to the Swimming Pool Complex, provided, however, that such furniture does not disrupt the operations of the Swimming Pool Complex.
7.3 Glass
No glass containers of any type may be brought into the Swimming Pool Complex.
7.4 Health
Individuals with apparent skin diseases, sore or inflamed eyes, coughs, colds, ear or nasal discharge, or wearing bandages (no Band-Aids), may not enter the swimming pool.  Swim diapers need to be worn for children whom are not potty trained.
7.5 Horseplay
All potentially harmful horseplay, including dunking and wrestling, is prohibited.
7.6 Music
Music may not be played in the Swimming Pool Complex, except by way of headphone-only (Walkman type) radios or players.  Family Friendly type music may be provided by the Pool Manager for the entire Swimming Pool Complex.
7.7 Personal property
All Individuals must remove their personal property, including furniture, from the Swimming Pool Complex when leaving the Swimming Pool Complex.  The lost and found will be thrown out every first and fifteenth of each month.
7.8 Food
The consumption of food and drink in the Swimming Pool Complex shall be permitted at the lifeguards discretion provided, however, that no food or drink may be taken into the swimming pool.
7.9 Pets
No pets are allowed in the Swimming Pool Complex.
7.10 Profanity
The use of profanity in the Swimming Pool Complex is prohibited.
7.11 Running
Running is prohibited.
7.12 Screaming
Screaming is prohibited
7.13 Spitting
Spitting, spouting water, and blowing nose in the swimming pool is prohibited.
7.14 Trash
All trash must be promptly placed in the appropriate receptacles.  All Individuals are responsible for ensuring that all trash is properly disposed of.
7.15 Water toys and water devices
Use of water toys and water devices, including but not limited to balls, flotation beds, snorkels, fins and volleyball nets shall be permitted at the discretion of the lifeguard and only if such use if not disruptive to other individuals enjoyment of the Swimming Pool Complex.

8. Guest Policy

8.1 Member must accompany guest
No guest may remain in the Swimming Pool Complex unless accompanied by a Member of their host household.
8.2 Fees
A daily fee of One Dollar ($1.00) per guest must be paid to the lifeguard upon entry to the Swimming Pool Complex.

9. Hours and Season of Operation

9.1 Season
The Swimming Pool Complex’s season of operation shall be determined yearly by the Associations Board of Directors.
9.2 Hours
The Swimming Pool Complex’s hours or operation shall be determined yearly by the Associations Board of Directors.

10. Lifeguard

10.1 Lifeguard Must be Present
Swimming is prohibited at all times unless a lifeguard supplied by the Pool Manager is present at the Swimming Pool Complex.
10.2 Chair
No one except the lifeguard may sit on the lifeguards chair.

11. Private Parties

11.1 General Availability
A Member may rent the Swimming Pool Complex to host a private party.
11.2 Applicability of Rules
These Rules shall be in full force and effect during any private party held at the Swimming Pool Complex.
11.3 Time
Parties may only be held before or after Regular Hours but not after 11:00 P.M.
11.4 Fees
The fees charged to a Member hosting a private party at the Swimming Pool Complex shall be as follows:

1. $60 refundable deposit
2. $30 per hour non-refundable usage fee (2 hour minimum)
3. $15 per hour per lifeguard. (Contract will stipulate terms of the number of lifeguards required.)

11.5 Application of Deposit
The $60.00 refundable deposit shall be applied by the Association to pay for any damage that may result to the Swimming Pool Complex during the renting Members private party.  The Association shall have the right to recover from the Member hosting a private party all additional reasonable funds expended to repair damage caused to the Swimming Pool Complex during the course of the Members party.
11.6 Members Presence Required
The host Homeowner must be present at all times during a private party hosted by that Member.
11.7 Rental Restricted to Members
Only Members may rent the Swimming Pool Complex to host a party.
11.8 Clean up
The Member hosting a party must ensure that the Swimming Pool Complex is left in a clean condition after the party or deposit will be forfeited.
11.9 Reservations
The Swimming Pool Complex may not be used for a party unless the Swimming Pool Complex is reserved at least 48 hours before the party is scheduled to begin.  No reservation shall be deemed to have occurred unless all fees set forth in Paragraph 11.4 of these Rules shall be paid at least 48 hours before the time of the subject party is scheduled to begin.
11.10 First Come/First Serve
The reservations of the Swimming Pool Complex for parties shall be on a first come first serve basis.
11.11 Eligibility to Host Party
No Member may host a party unless that Member has paid the annual assessment mandated by the By-laws.
11.12 No Parties during Regular Hours
No parties, private or otherwise, including birthday parties, may be held during Regular Hours.

12. Sign-In

12.1 Sign-In
All Individuals must sign-in the registration log when entering the Swimming Pool Complex.

13. Swimming Lessons & Swim Team

13.1 License
The Pool Manager is authorized to provide swimming lessons and swim team to the Members of Homestead.
13.2 Time
The Pool Manager may utilize the Swimming Pool Complex to provide swim lessons and swim team provided, however, that all lessons must occur before, and be completed by, the commencement of Regular Hours.
13.3 Fees
The Pool Manager may charge a fee for its swimming lesson and swim team services.  Said fee shall be approved annually by the Associations Board of Directors before it may be assessed by the Pool Manager.

14. Association Activities

14.1 The Association, by vote of its Board of Directors, may sponsor special events at the Swimming Pool Complex.
